Privacy Ordinance Notice and Consent - apply to individuals

  1. From time to time, it is necessary for you to supply Delta Asia Credit Limited ("DAC") with personal data and other information in connection with the opening or continuation of accounts and the establishment or continuation of credit facilities or provision of financial services.

  2. Failure to supply any such data or information may result in DAC being unable to open or continue accounts or establish or continue credit facilities or provide financial services.

  3. It is also the case that data and information are collected from you in the ordinary course of the continuation of the business relationship.

  4. The purposes for which personal data relating to you may be used are as follows:

    1. the daily operation of the financial services and credit facilities provided to you;
    2. conducting credit checks;
    3. assisting other financial institutions to conduct credit checks;
    4. ensuring your ongoing credit worthiness;
    5. designing financial services or related products for your use;
    6. marketing financial services or related products;
    7. determining the amount of indebtedness owed to or by you;
    8. collection of amounts outstanding from you and those providing security for your obligations;
    9. meeting the requirements to make disclosure, whether under the requirements of any law or regulation binding on DAC or at the request of no legal force of any regulator to which DAC is subject; and
    10. purposes relating to any of the foregoing.

  5. Personal data held by DAC relating to you will be kept confidential but DAC may provide any such data to:

    1. any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment, debt collection, credit reference, professional or other services to DAC in connection with the operation of its business;
    2. any other branch of DAC
    3. any other member of Delta Asia Financial Group ("Group") of which DAC is one of the group members;
    4. any other person under a duty of confidentiality to DAC;
    5. any financial institution with which you have or propose to have dealings; and
    6. any actual or proposed assignee of DAC or participant or sub-participant or transferee of DAC's rights in respect of you.

  6. You acknowledge that you have the right to request to:
    1. check whether DAC holds your personal data and the right of access to such data;
    2. correct or update any of your personal data held by DAC; and
    3. ascertain DAC's policies and practices in relation to your personal data and be informed of the kind of personal data held by DAC.

  7. DAC may charge a modest fee for processing any of the requests abovementioned in paragraph F. Any such request are to be addressed to:

  8. DAC shall not have any liability to you or any other person if any personal data or information supplied by or for you or about you is incomplete or inaccurate.

  9. You hereby authorize that DAC and/or any member(s) of the Group may use data about you and thus supply you with information about other services or products of DAC or any member(s) of the Group. You understand that, if you request, without charge to you, DAC or any member of the Group, as the case may be, to cease to use such data for such purpose, and if you so inform DAC in writing, such data shall be ceased to be so used.

  10. In order to open any account or continue any account of you, you hereby authorize DAC to compare data and information provided by you with other data and information collected about you for checking purposes or to produce more data and information. DAC may use the results of such comparisons for the purposes of taking any action including actions, which may be adverse to your interest e.g. refusing to open any account or discontinuing any account of you.

  11. In this Privacy Ordinance Notice and Consent, words importing the singular shall include the plural and vice versa and references to a person shall include individual, body corporate or unincorporated.
